Public consignment Information
PLEASE READ THE AUCTION CONTRACT BELOW, YOU WILL RECEIVE A HARD COPY TO SIGN WHEN YOU DELIVER YOUR ITEMS TO THE AUCTION SITE.
1. Bargain Monkey Enterprises Inc. DBA Exit59 Auctions agrees to conduct a public auction. Located at 10676 Bennett Rd E. Dunkirk, NY. 14048
2. Owner of Merchandise hereby employs Exit59 Auctions to conduct the auction and agrees to pay a set commission rate of 20% or agreed upon rate prior to auction start.
3. Owner will be paid as follows (Auctioneer does not guarantee Buyers checks): By Check; No later than ten (10) working days after conclusion of the auction.
4. Space is Limited. Please no non saleable goods. We reserve the right to refuse any goods not fit for Auction. Call for any information regarding consignments.
5. Exit59 Auctions will not be responsible at any time for pilferage, destruction by fire, weather, or any other loss of, or damage to any property to be sold or associated with the auction. The Auctioneer will not be responsible for cleanup or items that do not sell.
6. Owner warrants that the property to be sold is free and clear of all liens and encumbrances.
7. Owner agrees that no item or items listed on the attached Auction consignment form are to be sold or disposed of prior to the auction.
8. Owner agrees to accept the highest offer or bid received at the auction without reservation unless noted.
9. Exit59 Auctions is NOT RESPONSIBLE to pay the owner for any item a bidder may bid on and not pay for.
10. It is expressly agreed and understood that Box Monkey Enterprises Inc, DBA Exit59 Auctions is merely acting as an agent on behalf of the seller and does not make any representation or warranty as to the condition or terms of the sale or the above-described property of the auction company.
11. Box Monkey Enterprises Inc, DBA Exit59 Auctions does not guarantee any checks received from purchasers. Settlement is made to the Sellers within 10 banking days after such sale and all checks have cleared the escrow of the auction company.
12. The Seller acknowledges that all information provided on the Consignment Form is accurate and reliable and the Seller has disclosed all known defects.
13. Unsold Items will be removed from the premises by 3pm the day following the auction. If they are not removed they become property of Exit59 Auctions and the owner will be assessed a $5.00 per table and/or $5.00 furniture dumpster fee which will be taken from the proceeds of their sale total.
14. Receiving consignments Monday, Tuesday 9:00 am to 5:00 pm & Wednesday 9:00am-12:00pm only.
15.Seller acknowledges that he has read, understands and agrees to abide by the Terms and Conditions of this auction and agrees to consign the items listed on this form.
Conditions of Sale
CONDITION OF ITEMS SOLD: The auctioneer shall not be responsible for the correct description, authenticity of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made, or sale set aside on account of any incorrectness, error in cataloging, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold as is and without recourse.

Items MUST BE PICKED UP NO LATER THAN 4:00PM ON Fridays FOLLOWING THE AUCTION OTHERWISE YOU WILL BE CHARGED $10.OO PER DAY PER LOT STARTING ON MONDAY FOLLOWING THE AUCTION. WE MUST CLEAR OUR SHOWROOM FOR THE NEXT AUCTION THANK YOU FOR YOUR UNDERSTANDING AND FOR PICKING UP YOUR ITEMS.
ONLINE BIDDERS: YOU MUST PAY WITHIN 24 HOURS OF THE END OF AUCTION YOU ARE ALSO RESPONSIBLE TO PAY FOR SHIPPING SEPARATE. SHIPPING WILL BE PROCESSED ONCE PAYMENT HAS BEEN RECEIVED. IF YOU DO NOT HAVE YOUR ITEMS PICKED UP AND/OR SHIPPED, YOU WILL START TO ACCUMULATE STORAGE FEES STARTING MONDAY AFTER THE AUCTION AT A RATE OF $10.00 PER DAY PER LOT. WE CANNOT STORE YOUR ITEMS. AFTER 5 DAYS OF NO PAYMENT AND NOT HAVING A SHIPPER PICK YOUR ITEMS UP THEY WILL BE CONSIDERED ABANDONED AND FORFEITED WHETHER THEY ARE PAID OR NOT PAID THIS WILL BE THE FRIDAY FOLLOWING THE AUCTION APPROXIMATELY 5 DAYS.
All items purchased must be removed from the facility by 4:00 pm following the day of auction. Exit59 Auctions is not responsible for items left after purchase. Any items not removed from the facility day of auction are left at buyers own risk.
Any items left after time allowed will be subject to a $10.00 per day storage fee plus any expenses required for moving those items. Any items left after five calendar days constitutes forfeiture of the items and assets will become property of Exit59 Auctions and will be sold at next available auction.
INSPECTION AND PER-REGISTRATION: All buyers are encouraged to inspect all items prior to bidding. Preview starts Thursday 10AM-5PM.
REGISTRATION: All purchasers are required to register and give the necessary information requested. You are responsible for all purchases made with your number.
TERMS: All purchases require PAYMENT-IN-FULL at the end of auction. CASH, Check w/ID Credit Cards (3% fee).
SALES TAX: Unless a tax resale license is provided prior to date of sale, the purchaser will be required to pay the combined New York State and local sales tax.
PAYMENT DEADLINE FOR ALL BIDDERS: An account becomes overdue and in default 24 hours after the auction has been completed.
NO WARRANTY: Everything in this auction is being sold "AS IS - WHERE IS" to the highest bidder, without warranty or guarantee of any kind. ALL SALES ARE FINAL. Exit59 Auctions is not responsible for missing or broken items after the auctioneer sells that item. ABSOLUTELY NO REFUNDS.

SALES LIST: A sales list may or may not be furnished by the auctioneer. No guarantee as to the accuracy or description is made. Deletions and additions may take place.
SHIPPING: Bidders are responsible for paying shipping of all items purchased.
REMOVAL: All items require PAYMENT-IN-FULL and an authorized receipt prior to removal. All items must be removed from the premises after the live auction. Failure to remove items by said time constitutes forfeiture of the items and the assets will become the property of Exit59 Auctions and may be sold at the next scheduled auction.
PERSONAL AND PROPERTY RISK: Persons attending the auction or preview, during exhibition, sale or removal goods assume all risks of damage of or loss to person or property and specifically release the auctioneer from liability therefore. Neither the auctioneer nor his principal(s), nor his clients shall be liable by reason of any defect in, or condition of the premises on which the sale is held. Bidder Acknowledges responsibility for any personal injury or property damage caused by bidder or bidders agents, employees and representatives for and from (a) any and all personal injury to bidder and bidder agents, (b) any property damage occurring at the auction premises, and any and all suits, claims, damages, costs and expenses of every kind and nature which may or might be asserted against any of them as a result of the actions or omissions of bidder and or bidders agents.
ADDITION TO OR WITHDRAWAL FROM SALE: The auctioneer reserves the right to withdraw from the sale any property listed and also to add property not listed to the sale.
AGENCY: The auctioneer is only an agent and is not responsible for the actions of his consignor(s)/client(s).
TITLE: When the item is announced "SOLD" by the auctioneer/online bidding system it immediately becomes the buyer's responsibility. Title to the item transfers to the buyer at that time. The seller(s), however, maintain a first security interest in all items until payment is received, including the collection of all funds. Exit59 Auctions and its personnel assume no responsibility for any missing or damaged items and are not acting as the buyer's security agent. Exit59 Auctions WILL NOT REFUND ANY BUYER FOR MISSING, STOLEN OR BROKEN ITEMS.
BUYBACKS & Shill Bidding: Exit59 Auctions does not permit consignors to repurchase or bid on their consigned items. If you suspect that this is occurring, please bring it to the attention of the auctioneer.
All internet winning bidders must pay their invoice within 24 hours of the day of auction end.
REWARD: A $250.00 reward will be paid to anyone who leads to the arrest and prosecution of any person caught stealing, renumbering, or shuffling items from lot to lot; before, during or after the auction. Any and all theft will be prosecuted to the full extent of the law.
Payment Information
All purchases require PAYMENT-IN-FULL at the end of live auction. CASH, Check w/ID Credit Cards (3% fee). Failure to pay will result in banning of future auction participation at any Exit59 auctions
Shipping Terms
Shipping Terms: Exit59 Auctions DOES IN-HOUSE SHIPPING. Items purchased that require shipping will be processed after payment has been received. Once items have been paid for they will be sent to the shipping department to be processed and packaged. When packaging is complete, you will receive a shipping invoice via email and text. After the shipping invoice has been sent out you have 7 days to submit payment, if payment is not made within those 7 days the items will be forfeited. WE CANNOT STORE YOUR ITEMS. Depending on the item's size, weight, etc, they may be sent to a third-party shipper or require specialty shipping.
SHIPPING: Bidders are responsible for paying shipping of all items purchased, we will take care of getting them processed to ship once payment has been received.
Condition of Items Sold
